Ruth Bader Ginsburg was a Justice on the Supreme Court of the United States. Justices are appointed for live and surrender their position if the resign, they are impeached and removed, or if they die. They are Justices of the Supreme Court but are not given seats nor are there certain number of places reserved for Justices perceived to be of a certain political persuasion.
We are being led to believe that when Ruth Bader Ginsburg died, the seat was hers and the new justice nominated and confirmed must be a clone of hers. We are being led to belief that because she was perceived to be of a certain political persuasion, the nominee and confirmed justice must be the same. Nothing good be further from the truth. The President has no limitations on whom they will nominate nor does the Senate have any limitations on whom they will confirm. The seat is always the people’s seat. The reference to this as the seat of Ruth Bader Ginsburg’s is a concerted effort to attempt to mislead the American people. The reference that this position should be filled by another perceived to be of the same political persuasion is also an attempt to mislead the American people. The seat is the seat of the American people. The political persuasion of a nominee ideally should be of no consequence. The intent, and properly so, is that all justices will never allow political persuasion to influence their rulings but will only rely on the Constitution and the law as written. If a judge is influenced by their political persuasion, or reads into the Constitution or law that is not there, is in fact acting beyond the scope of their authority. The role of a justice is simply to render an opinion and never to make policy or engage in politics.
