RULE OF LAW OR ARBITRARY LAW

The United States of America was formed to be a Republic, a Constitutional Republic. A republic is where a nation regards the law as the supreme ruler. In a Constitutional Republic that law is written. In the United States the law is written in our Constitution and so that means that the Constitution is the Supreme law of the land. A republic, a constitutional republic can only continue when the “rule of law” is upheld.
The counter part to a republic would be where the supreme ruler is other than the law. This could be anything from an autocracy to a democracy. People become the supreme ruler and they declare the law to be whatever they deem they want it to be with no restrictions or limitations other than what they might impose on themselves. This is called arbitrary law and is practiced in governments ranging from an autocracy to a democracy. Yes, a democracy is in fact a form of dictatorship. This is one of the reasons our founder’s rejected democracy.
The Rule of Law is one of the essential principles that form the basis for our Constitution. It ensures equal protection under the law and helps to limit governmental power over citizens. The Rule of Law is a concept that dates back to ancient Greek and Roman philosophers. It states that all people should be treated equally under the law regardless of their wealth or social position in society. Rules are not designed as a means for one group to gain an advantage over another, and they should never be used to punish or favor a particular individual. It is the basic foundation for the Constitution. The Constitution is the fundamental law that provides this structure, but it includes treaties and laws passed by Congress.
Dictatorships, from autocracies to democracies, have an individual or body of people who determine what the law will be. They have no limitations or restrictions. They are not obligated to honor liberties and rights for the minority. Whereas in a republic the law must be adjudicated equally with no regard to factors such as social justice, social position, economic position, race, gender, or political position. When arbitrary law is applied, the above factors can be and are factors in adjudicating. When arbitrary law is applied, those in power can apply a law or disregard a law depending on the outcome they desire. There is no regard to fairness or consistency, only to desired outcome in that particular situation.
Rule of law is essential for a society that desires freedom and believes in individual liberty and individual rights. Arbitrary law is applied to transition a society from a free society to a government-controlled society and is maintained until tyranny and despotism become reality within a society.
This is the transition the left has promised for the United States as they attempt to fulfill their promise of transforming the United States from a Constitutional Republic to a Democracy to a socialist nation to a communist totalitarian state.
