The role of the legislative branch was to control the money of the country including passing budgets. Their other functions included debating and passing law. The founders intended that this process be a slow deliberate process. A part of this process was to reject bills as well as pass bills. The role of the executive branch was to administer the law. Last night we saw the executive branch say they must write law since the congress would not.
Obama said, “And to those Members of Congress who question my authority to make our immigration system work better, or question the wisdom of me acting where Congress has failed, I have one answer: Pass a bill.” According to the constitution the executive does not have the power to unilaterally act because congress would not. A dictator certainly would have that power, but then a dictator abhors rule of law and cannot and will not abide by it.
Our founders warned us about this type of action; that being one branch usurping the role and power of another. Thomas Jefferson said, “If the three powers maintain their mutual independence on each other, our Government may last long, but not so if either can assume the authorities of the other.” Thomas Jefferson in essence told us the life of our Government as we know it, just became must shorter last night for the executive branch once again assumed the authority of the legislative branch. But then this is what Obama told us he would do and has shown that it is what he wants to do; end a country based on rule of law and transform it to a country based on arbitrary law. It was from a country based on arbitrary law that our founders rebelled. Now, led by Obama, we have reverted to that very type of government from which we rebelled.
